{"id":1544,"date":"2023-11-21T12:18:47","date_gmt":"2023-11-21T12:18:47","guid":{"rendered":"https:\/\/www.concentricab.com\/?page_id=1544"},"modified":"2023-11-21T12:23:14","modified_gmt":"2023-11-21T12:23:14","slug":"policy-regarding-harassment-sexual-harassment-and-retaliation","status":"publish","type":"page","link":"https:\/\/www.concentricab.com\/se\/policy-regarding-harassment-sexual-harassment-and-retaliation\/","title":{"rendered":"Policy regarding harassment, sexual harassment, and retaliation"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p><strong>Policy regarding harassment, sexual harassment, and retaliation<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>1 CONCENTRIC\u2019S COMMITMENT<\/strong><\/p>\n\n\n\n<p>Concentric has zero tolerance for any form of harassment or sexual harassment at work, whether<\/p>\n\n\n\n<p>occurring at or outside the workplace, including conduct on social media.<\/p>\n\n\n\n<p>It is of utmost importance for Concentric that individuals feel safe at work and have the courage to speak<\/p>\n\n\n\n<p>up against any form of unwelcomed or offensive conduct. Individuals therefore need to understand that<\/p>\n\n\n\n<p>no retaliation will be taken if individuals report or participate in any investigation into alleged harassment<\/p>\n\n\n\n<p>or sexual harassment.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>2 WHO IS THIS POLICY FOR?<\/strong><\/p>\n\n\n\n<p>This Policy applies to everyone at Concentric and is applicable in all our business operations.<\/p>\n\n\n\n<p>Accordingly, the Policy applies to every employee and representative of Concentric, including its<\/p>\n\n\n\n<p>subsidiaries, members of the Board of Directors as well as anyone working on behalf of Concentric.<\/p>\n\n\n\n<p><strong>Harassment includes<\/strong> any conduct, statement, or gesture, both physical and verbal, which denigrates,<\/p>\n\n\n\n<p>ridicules, devalues, insults, or offends a person&#8217;s dignity and which is associated with at least one of the<\/p>\n\n\n\n<p>protected characteristics.<\/p>\n\n\n\n<p><strong>Sexual harassment includes<\/strong> any conduct of a sexual nature which offends a person&#8217;s dignity, such as<\/p>\n\n\n\n<p>groping and other unwelcomed physical touching, sexual insinuations, compliments, invites, glances,<\/p>\n\n\n\n<p>gestures, nicknames, comments about physical appearance, clothing or private life, and pornographic<\/p>\n\n\n\n<p>images.<\/p>\n\n\n\n<p><strong>Protected characteristics include the following list <\/strong>which should not be regarded as exhaustive and<\/p>\n\n\n\n<p>may differ by country: gender, transgender identity or expression, ethnicity, religion or other religious<\/p>\n\n\n\n<p>belief, disability, sexual orientation, age.<\/p>\n\n\n\n<p>Harassment and sexual harassment do not require intent on the part of the harasser. Instead, the person<\/p>\n\n\n\n<p>subjected to the conduct decides if the conduct is unwelcome or offensive and constitutes harassment<\/p>\n\n\n\n<p>or sexual harassment. However, the harasser needs to understand that their conduct is unwelcomed or<\/p>\n\n\n\n<p>offensive. It is therefore important that employees, experiencing any form of unwelcomed or offensive<\/p>\n\n\n\n<p>conduct, immediately speak up.<\/p>\n\n\n\n<p><strong>If individuals experience, witness, or suspect any form of harassment or sexual harassment at<\/strong><\/p>\n\n\n\n<p><strong>work<\/strong> they should immediately report the incident to their manager or Human Resources. Refer to the<\/p>\n\n\n\n<p>\u201c<strong><em>Guidelines for reporting harassment, sexual harassment, and retaliation<\/em><\/strong>\u201d for further guidance.<\/p>\n\n\n\n<p>Whenever Concentric receives a report about harassment or sexual harassment we act swiftly and<\/p>\n\n\n\n<p>immediately launch an investigation into the reported incident. In connection with such investigation<\/p>\n\n\n\n<p>Concentric may need to interview the reporting person, the person allegedly subjected to harassment<\/p>\n\n\n\n<p>or sexual harassment (if another than the reporting person), the alleged harasser, and any additional<\/p>\n\n\n\n<p>witnesses. Concentric will also need to document what has taken place. Any investigative measures will<\/p>\n\n\n\n<p>be taken with due regard, consideration, and respect for all involved parties.2<\/p>\n\n\n\n<p>Based on the outcome of the investigation, Concentric will take necessary action to prevent and combat<\/p>\n\n\n\n<p>continued and future harassment and sexual harassment. The action that may need to be taken<\/p>\n\n\n\n<p>depends on the circumstances in each individual case.<\/p>\n\n\n\n<p><strong>Guidelines for reporting harassment, sexual harassment,<\/strong><\/p>\n\n\n\n<p><strong>and retaliation<\/strong><\/p>\n\n\n\n<p><strong>Concentric does not accept any form of harassment or sexual harassment<\/strong> occurring at or in<\/p>\n\n\n\n<p>connection with work. Concentric will therefore take immediate action upon receiving a report or upon<\/p>\n\n\n\n<p>suspicion arising about any form of harassment or sexual harassment.<\/p>\n\n\n\n<p><strong>No retaliation will be taken<\/strong> if individuals report or participate in any investigation into alleged<\/p>\n\n\n\n<p>harassment or sexual harassment.<\/p>\n\n\n\n<p><strong>These guidelines provide advice about<\/strong>:<\/p>\n\n\n\n<p>(i) how to act if individuals experience or witness harassment or sexual harassment;<\/p>\n\n\n\n<p>(ii) how to report experienced or witnessed harassment or sexual harassment;<\/p>\n\n\n\n<p>(iii) the actions taken by Concentric when a report is received; and<\/p>\n\n\n\n<p>(iv) the employment law measures that Concentric may take.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>1 IN THE CASE OF HARASSMENT OR SEXUAL HARASSMENT<\/strong><\/p>\n\n\n\n<p>1. <strong>Individuals should not blame themselves<\/strong>.<\/p>\n\n\n\n<p>2. <strong>Speak up.<\/strong> It is important that the harasser understands that their conduct is<\/p>\n\n\n\n<p>unwelcomed or offensive.<\/p>\n\n\n\n<p>3. <strong>Make comprehensive notes <\/strong>of the incident (including date, time of day, potential<\/p>\n\n\n\n<p>witnesses, or by-standers, what was said or done, reaction).<\/p>\n\n\n\n<p>4. <strong>Individuals should let their manager know if any specific support measures<\/strong>, such<\/p>\n\n\n\n<p>as counselling, are needed.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>2 REPORT HARASSMENT OR SEXUAL HARASSMENT<\/strong><\/p>\n\n\n\n<p>If an individual experiences, witness, or suspect any form of harassment or sexual harassment<\/p>\n\n\n\n<p>at or in connection with work they should immediately report the incident:<\/p>\n\n\n\n<p>(a) to their manager; or, if for some reason reporting the incident to their manager would be<\/p>\n\n\n\n<p>inappropriate,<\/p>\n\n\n\n<p>(b) to Human Resources.<\/p>\n\n\n\n<p>Refer to Concentric\u2019s whistleblowing policy for further information, for example on how to raise<\/p>\n\n\n\n<p>a complaint anonymously.<\/p>\n\n\n\n<p>The individual\u2019s manager or another senior manager if appropriate, supported by Human<\/p>\n\n\n\n<p>Resources, is responsible for initiating an investigation into the reported incident as a matter<\/p>\n\n\n\n<p>of urgency.<\/p>\n\n\n\n<p>The CEO is ultimately responsible for ensuring that Concentric fulfils its legal obligations.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>3 INVESTIGATIVE MEASURES TAKEN BY CONCENTRIC<\/strong><\/p>\n\n\n\n<p>If an individual wishes for Concentric not to initiate, or to cease, any investigation into the<\/p>\n\n\n\n<p>reported incident, Concentric will take this into consideration. However, note that Concentric\u2019s<\/p>\n\n\n\n<p>position is that all incidents involving harassment and sexual harassment need to be<\/p>\n\n\n\n<p>investigated to respond appropriately to ensure a work environment free of harassment and<\/p>\n\n\n\n<p>sexual harassment.<\/p>\n\n\n\n<p><strong>3.1 Initial information is collected<\/strong><\/p>\n\n\n\n<p>In order to allow Concentric to thoroughly investigate the reported incident individuals will be<\/p>\n\n\n\n<p>requested to recount the incident.<\/p>\n\n\n\n<p>This may include<strong> describing the following<\/strong>:<\/p>\n\n\n\n<p>1. The date and time of the incident &#8211; when and where did the incident occur?<\/p>\n\n\n\n<p>2. Whether anyone else witnessed the incident?<\/p>\n\n\n\n<p>3. Whether anyone else has been subjected to similar conduct?<\/p>\n\n\n\n<p>4. The individual\u2019s reaction.<\/p>\n\n\n\n<p>Any information collected in connection with an investigation will be processed in accordance<\/p>\n\n\n\n<p>with applicable law, including the General Data Protection Regulation (\u201c<strong>GDPR<\/strong>\u201d) or equivalent<\/p>\n\n\n\n<p>legislation.<\/p>\n\n\n\n<p><strong>3.2 Additional information is collected<\/strong><\/p>\n\n\n\n<p>The additional investigative measures that Concentric may take include <em>inter alia<\/em>:<\/p>\n\n\n\n<p>1. Interview any potential witness(es) or by-stander(s).<\/p>\n\n\n\n<p>2. Interview the alleged harasser(s).<\/p>\n\n\n\n<p>3. Review any text(s), sign(s), poster(s) or other document(s), or scribble or drawing(s).<\/p>\n\n\n\n<p>4. Review any recording(s).<\/p>\n\n\n\n<p>5. Review any e-mail or text message(s) or other message(s) sent using social media.<\/p>\n\n\n\n<p>6. Engage a third-party forensic investigator to perform a forensic investigation.<\/p>\n\n\n\n<p>7. Engage and consult with an external legal advisor.<\/p>\n\n\n\n<p><strong>3.3 Continuous communication<\/strong><\/p>\n\n\n\n<p>Parties, will be informed about the investigative measures taken and progress of the<\/p>\n\n\n\n<p>investigation and any actions that Concentric intends to take. Information provided will be<\/p>\n\n\n\n<p>limited so as not to violate any person\u2019s integrity.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>4 POTENTIAL EMPLOYMENT LAW MEASURES<\/strong><\/p>\n\n\n\n<p>Based on the outcome of the investigation, Concentric will take necessary action to prevent<\/p>\n\n\n\n<p>and combat continued and future harassment and sexual harassment.<\/p>\n\n\n\n<p><strong>The employment law measures which Concentric may need to take include<\/strong>, <em>inter alia<\/em>:<\/p>\n\n\n\n<p>1. Launching an information campaign or training.<\/p>\n\n\n\n<p>2. Suspension of parties involved.<\/p>\n\n\n\n<p>3. Issuing a reprimand.4<\/p>\n\n\n\n<p>4. Issuing a reminder.<\/p>\n\n\n\n<p>5. Dismissal with notice.<\/p>\n\n\n\n<p>6. Dismissal without notice.<\/p>\n\n\n\n<p><strong>In case of a serious incident<\/strong> (e.g., an incident that constitutes a gross violation of<\/p>\n\n\n\n<p>Concentric\u2019s<em> policy regarding harassments, sexual harassment and retaliation<\/em> or could<\/p>\n\n\n\n<p>amount to a criminal offence), Concentric will, unless the circumstances warrant otherwise,<\/p>\n\n\n\n<p>dismiss the harasser, either with or without notice. Further, Concentric may need to report the<\/p>\n\n\n\n<p>incident to the police.<\/p>\n\n\n\n<p>Concentric will also follow-up in order to ensure that any harassment or sexual harassment<\/p>\n\n\n\n<p>has ceased.<\/p>\n\n\n\n<p>Concentric is under no obligation to take any action should the investigation show that the<\/p>\n\n\n\n<p>reported incident does not amount to harassment or sexual harassment as defined in<\/p>\n\n\n\n<p>applicable law.<\/p>\n\n\n\n<p>Individuals should also be aware that completely unfounded reports may in themselves<\/p>\n\n\n\n<p>constitute harassment.<\/p>\n\n\n\n<p><strong>Guidelines for investigating harassment and sexual harassment,<\/strong><\/p>\n\n\n\n<p><strong>and prohibition against retaliation<\/strong><\/p>\n\n\n\n<p>These guidelines set out the investigative measures that must be taken in immediate connection with<\/p>\n\n\n\n<p>either: a) receiving a report about alleged harassment or sexual harassment; or b) suspicion arising<\/p>\n\n\n\n<p>about harassment or sexual harassment; at or in connection with work.<\/p>\n\n\n\n<p>The following Sections contain information about:<\/p>\n\n\n\n<p>(v) What constitutes harassment.<\/p>\n\n\n\n<p>(vi) What constitutes sexual harassment.<\/p>\n\n\n\n<p>(vii) Concentric\u2019s legal obligation to act.<\/p>\n\n\n\n<p>(viii) The prohibition against retaliation.<\/p>\n\n\n\n<p>(ix) The preventative action that Concentric is legally obliged to take.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>1 WHAT CONSTITUTES HARASSMENT?<\/strong><\/p>\n\n\n\n<p>Harassment includes any form of physical, verbal, or non-verbal conduct which harms or<\/p>\n\n\n\n<p>causes discomfort and thus violates a person&#8217;s dignity and which is associated with at least<\/p>\n\n\n\n<p>one of the following protected characteristics:<\/p>\n\n\n\n<p>1. <strong>Gender<\/strong>: This characteristic is gender neutral and aims to protect both females and<\/p>\n\n\n\n<p>males. In addition, the characteristic protects persons who intend to change or have<\/p>\n\n\n\n<p>changed their gender. Harassment associated with gender includes <em>inter alia <\/em>not<\/p>\n\n\n\n<p>allowing females to be heard in connection with meetings or assigning skilled females<\/p>\n\n\n\n<p>unskilled work duties.<\/p>\n\n\n\n<p>2. <strong>Transgender identity or expression<\/strong>: This characteristic aims to protect persons who<\/p>\n\n\n\n<p>self-identify with or who through their clothing or otherwise express that they belong to<\/p>\n\n\n\n<p>another gender than their biological gender as assigned to them at birth. Harassment<\/p>\n\n\n\n<p>associated with transgender identity or expression includes <em>inter alia<\/em> ostracizing or<\/p>\n\n\n\n<p>excluding them from using changing rooms or toilets at work.<\/p>\n\n\n\n<p>3. <strong>Ethnicity<\/strong>: This characteristic aims to protect persons from harassment due to their<\/p>\n\n\n\n<p>nationality or ethnic origin, their skin colour or other similar trait. This characteristic also<\/p>\n\n\n\n<p>protects persons from harassment due to their connection to an ethnic person.<\/p>\n\n\n\n<p>Harassment associated with ethnicity includes <em>inter alia <\/em>racist jokes or nicknames.<\/p>\n\n\n\n<p>4. <strong>Religion or other religious belief<\/strong>: This characteristic includes both recognised<\/p>\n\n\n\n<p>religions and other beliefs that are based on or connected with a religious belief. Also,<\/p>\n\n\n\n<p>non-believers are protected under this characteristic. Harassment associated with<\/p>\n\n\n\n<p>religion or other religious belief includes <em>inter alia<\/em> offensive comments about attire worn<\/p>\n\n\n\n<p>for religious reasons or disparaging comments about traditions rooted in religion.<\/p>\n\n\n\n<p>5. <strong>Disability<\/strong>: This characteristic includes any permanent physical, mental, or intellectual<\/p>\n\n\n\n<p>impairment or limitation of a person\u2019s capacity to function. The characteristic includes<\/p>\n\n\n\n<p>disability that is a consequence of an injury or illness which existed at birth, occurred<\/p>\n\n\n\n<p>thereafter or can be expected to occur. The characteristic also protects persons from<\/p>\n\n\n\n<p>harassment due to their close relative\u2019s disability. Harassment associated with disability<\/p>\n\n\n\n<p>includes <em>inter alia<\/em> to ape or mimic a disabled person.<\/p>\n\n\n\n<p>6. <strong>Sexual orientation<\/strong>: This characteristic aims to protect all sexual orientations. It protects<\/p>\n\n\n\n<p>a person from harassment due to their sexual preferences, frequenting certain places<\/p>\n\n\n\n<p>associated with sexual preferences or their relationship or living arrangements.<\/p>\n\n\n\n<p>Harassment associated with sexual orientation includes <em>inter alia<\/em> implicit or<\/p>\n\n\n\n<p>unconscious bias.<\/p>\n\n\n\n<p>7. <strong>Age<\/strong>: This characteristic aims to protect persons from harassment due to their biological<\/p>\n\n\n\n<p>age. There is no minimum or maximum age; all ages are included. Harassment<\/p>\n\n\n\n<p>associated with age includes <em>inter alia<\/em> attributing a person certain character traits based<\/p>\n\n\n\n<p>on their generation.<\/p>\n\n\n\n<p>For conduct to constitute harassment, the conduct must be <strong>unwelcome<\/strong>. Further, the alleged<\/p>\n\n\n\n<p>harasser must understand that their conduct violates the dignity of the person subjected to the<\/p>\n\n\n\n<p>conduct due to their protected characteristic(s).<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>2 WHAT CONSTITUTES SEXUAL HARASSMENT?<\/strong><\/p>\n\n\n\n<p><strong>Sexual harassment includes<\/strong> any physical, verbal, or non-verbal conduct of a sexual nature<\/p>\n\n\n\n<p>which offends a person&#8217;s dignity by <em>inter alia<\/em> creating an offensive or intimidating work<\/p>\n\n\n\n<p>environment or hindering or interfering with a person\u2019s performance of their work.<\/p>\n\n\n\n<p>Examples include <em>inter alia <\/em>groping and other forms of unwelcome physical touching,<\/p>\n\n\n\n<p>unwelcomed sexual insinuations, compliments, invites, glances, gestures, nicknames and<\/p>\n\n\n\n<p>comments about physical appearance, clothing or private life, and pornography.<\/p>\n\n\n\n<p>For conduct to constitute harassment, the conduct must be <strong>unwelcome<\/strong>. The alleged sexual<\/p>\n\n\n\n<p>harasser must understand that their conduct is either unwelcome or offensive, save for when<\/p>\n\n\n\n<p>the conduct is \u201c<em>manifestly offensive<\/em>\u201d or where the person subjected to the conduct is in a<\/p>\n\n\n\n<p>subordinate or dependent position relative to the harasser.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>3 CONCENTRIC\u2019S LEGAL OBLIGATION TO ACT<\/strong><\/p>\n\n\n\n<p>Where Concentric becomes aware of a person at work experiencing harassment or sexual<\/p>\n\n\n\n<p>harassment Concentric is legally obliged to investigate and take reasonable action.6<\/p>\n\n\n\n<p><strong>Managers are obliged to take immediate action<\/strong> upon noticing or suspecting or receiving a<\/p>\n\n\n\n<p>report about any form of harassment or sexual harassment at work.<\/p>\n\n\n\n<p><strong>Managers must act swiftly &#8211; <\/strong>act as soon as they become aware of any form of alleged<\/p>\n\n\n\n<p>harassment or sexual harassment occurring or having occurred at or in connection with work.<\/p>\n\n\n\n<p><strong>Managers practice active listening<\/strong> &#8211; Face the person and have eye contact. Pay attention<\/p>\n\n\n\n<p>to non-verbal cues. Do not interrupt. Do not judge. Do not jump to conclusions. Have an<\/p>\n\n\n\n<p>objective approach. Pose open questions and request clarifications. Make notes.<\/p>\n\n\n\n<p><strong>Managers should consider the wishes of the person <\/strong>subjected to the alleged harassment<\/p>\n\n\n\n<p>or sexual harassment. Encourage the person to co-operate in the investigation:<\/p>\n\n\n\n<p>(i) inform the person of their rights and the protection afforded them under applicable<\/p>\n\n\n\n<p>law; Concentric will not retaliate, and will not tolerate that any other person<\/p>\n\n\n\n<p>retaliates, against them due to their co-operation;<\/p>\n\n\n\n<p>(ii) explain that all information uncovered in connection with the investigation will be<\/p>\n\n\n\n<p>handled with due regard, consideration, and respect for all involved parties; and<\/p>\n\n\n\n<p>(iii) explain that Concentric has zero tolerance for harassment and sexual<\/p>\n\n\n\n<p>harassment and consequently, that it is important that all instances of alleged<\/p>\n\n\n\n<p>harassment and sexual harassment are investigated to enable Concentric to take<\/p>\n\n\n\n<p>appropriate action to ensure a work environment free from harassment and<\/p>\n\n\n\n<p>sexual harassment.<\/p>\n\n\n\n<p>If the person nevertheless refuses to co-operate, make a note of this, remain in contact<\/p>\n\n\n\n<p>with the person, escalate the matter if necessary.<\/p>\n\n\n\n<p><strong>Managers must observe discretion. <\/strong>Any information received in connection with an<\/p>\n\n\n\n<p>investigation must be handled with discretion and with due regard, consideration, and<\/p>\n\n\n\n<p>respect for all involved parties.<\/p>\n\n\n\n<p><strong>Managers should plan meetings with implied persons well in advance. <\/strong>Prepare<\/p>\n\n\n\n<p>your interview questions. The questions you will need answered will of course vary from<\/p>\n\n\n\n<p>case to case. If you need assistance in identifying relevant questions turn to your Human<\/p>\n\n\n\n<p>Resources representative.<\/p>\n\n\n\n<p>It may be warranted to instruct the alleged harasser to perform work off-site or to offer<\/p>\n\n\n\n<p>them paid time-off from work during the investigation. It may in some cases also be<\/p>\n\n\n\n<p>warranted to wholly release the employee from their work duties.<\/p>\n\n\n\n<p><strong>Managers should gather evidence.<\/strong> Are there text messages, messages sent via<\/p>\n\n\n\n<p>social media, or e-mail messages containing unwelcome or offensive content? Are there<\/p>\n\n\n\n<p>phone records or records of sent text messages? Are there video or audio recordings<\/p>\n\n\n\n<p>or photographs of the incident? Are there signs, posters, scribble or drawings?<\/p>\n\n\n\n<p>In some cases, the alleged harasser may need to be instructed to return their work<\/p>\n\n\n\n<p>equipment to enable a forensic investigation. Document in writing the investigative<\/p>\n\n\n\n<p>measures taken.<\/p>\n\n\n\n<p><strong>Managers must analyze and draw a conclusion<\/strong>. The aim of the investigation is to<\/p>\n\n\n\n<p>conclude if the incident and reported conduct constitutes harassment or sexual<\/p>\n\n\n\n<p>harassment as defined in applicable law. Further, the investigation aims to discover any<\/p>\n\n\n\n<p>evidence in support of such conclusion and any potential subsequent employment law<\/p>\n\n\n\n<p>measures taken in relation to, typically, the alleged harasser.7<\/p>\n\n\n\n<p><strong>Managers should keep involved parties informed<\/strong> about the investigative measures<\/p>\n\n\n\n<p>taken and progress of the investigation. Upon conclusion of the investigation, inform<\/p>\n\n\n\n<p>involved parties about the action to be taken in order to prevent future harassment and<\/p>\n\n\n\n<p>sexual harassment.<\/p>\n\n\n\n<p>Manager should not disclose information which enables the alleged harasser (or anyone<\/p>\n\n\n\n<p>else) to obstruct the investigation (by e.g., eliminating evidence or intimidating<\/p>\n\n\n\n<p>witnesses). Nor should they disclose information that may violate a person\u2019s integrity.<\/p>\n\n\n\n<p><strong>Managers must take appropriate action<\/strong>. What constitutes appropriate action<\/p>\n\n\n\n<p>depends on the circumstances in each individual case.<\/p>\n\n\n\n<p><strong>As a manager, if you are unable to properly investigate the incident<\/strong>, appropriate<\/p>\n\n\n\n<p>action should be discussed with Human Resources.<\/p>\n\n\n\n<p><strong>If a manager concludes that the incident does not constitute harassment or<\/strong><\/p>\n\n\n\n<p><strong>sexual harassment<\/strong>, consider launching an internal information campaign or training<\/p>\n\n\n\n<p>about Concentric\u2019s values and what constitutes harassment and sexual harassment.<\/p>\n\n\n\n<p><strong>If a manager concludes that the incident constitutes harassment or sexual<\/strong><\/p>\n\n\n\n<p><strong>harassment<\/strong>, consider (in addition to the above) either:<\/p>\n\n\n\n<p>(a) issuing the harasser with a reprimand or reminder, or in case of aggravated<\/p>\n\n\n\n<p>harassment or sexual harassment.<\/p>\n\n\n\n<p>(b) terminating the harasser\u2019s employment either with or without notice.<\/p>\n\n\n\n<p>Note that employment law measures may need to be taken within certain time frames.<\/p>\n\n\n\n<p><strong>It is important to follow-up<\/strong> in order to ensure that the harassment or sexual<\/p>\n\n\n\n<p>harassment has ceased.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>4 PROHIBITION AGAINST RETALIATION<\/strong><\/p>\n\n\n\n<p>Concentric does not tolerate any form of retaliation against any person who rejects,<\/p>\n\n\n\n<p>denounces, or reports unwelcomed or offensive conduct. Nor does Concentric tolerate any<\/p>\n\n\n\n<p>retaliation against any person having co-operated in connection with an investigation into<\/p>\n\n\n\n<p>alleged harassment or sexual harassment.<\/p>\n\n\n\n<p>Any person having retaliated against any person having rejected, denounced, or reported any<\/p>\n\n\n\n<p>form of unwelcome or offensive conduct or having cooperated in any investigation into alleged<\/p>\n\n\n\n<p>harassment or sexual harassment will themselves be subject to employment law measures.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>5 PREVENTATIVE ACTION<\/strong><\/p>\n\n\n\n<p>Managers are obliged to:<\/p>\n\n\n\n<p>1. Ensure everyone within the team receives relevant training about harassment and<\/p>\n\n\n\n<p>sexual harassment. Keep a record of any training provided.<\/p>\n\n\n\n<p>2. Ensure an on-going discussion about Concentric\u2019s values. Cultivate openness in the<\/p>\n\n\n\n<p>workplace. Clearly communicate the boundaries of conduct that is accepted versus<\/p>\n\n\n\n<p>unaccepted.<\/p>\n\n\n\n<p>3.
